agency OVG needs to tackle Moroccan's deportation matter once more - Moroccan Deportation Issue Surfaces Yet Again for OVG
The Higher Administrative Court of Saxony (OVG) will reevaluate the controversial deportation of a Moroccan man residing in Chemnitz. In a recent decision, the Federal Constitutional Court in Karlsruhe determined that the OVG's ruling from July 2024 infringed upon the individual's fundamental rights, necessitating a reassessment of the case.
On July 11, the man was deported to his native Morocco despite an urgent suspension of the deportation by the Administrative Court in Chemnitz, which went unnoticed by federal police.
A few days after the deportation, the OVG ruled that the man not be returned to Germany. The legal standoff during this time also involved disputes over the denial of access to files requested by the man's lawyer. The Federal Constitutional Court deemed the OVG's decision to deny the complainant's request for access to the files as unjustified.
The Saxony Refugee Council branded the refusal to grant access to the files a scandal, stating that it represented a serious breach of the rule of law. The lawyer for the affected individual repeatedly sought access to the files and emphasized the implementation of the court order. However, the deportation proceeded regardless.
Inga Stremlau, representing the affected person, suggested that "prompt rectification of the significant rights violations would be appropriate, preferably through the expedited return of the affected party. If this is not immediately feasible, we recommend a straightforward and swift visa process as an alternative."
Saxony has witnessed recent unrest, such as protests against budget cuts in the state parliament and disputes surrounding cultural funding. However, these incidents do not appear to be directly related to the specific deportation case as detailed here.

The rulings of the Administrative Court in Chemnitz and the Higher Administrative Court of Saxony (OVG) in the controversial deportation of a Moroccan man highlight the complexity of migration policies within Germany. This situation, involving the denial of access to files requested by the man's lawyer, has sparked discussions around the rule of law and a call for a prompt rectification of rights violations, as suggested by Inga Stremlau. Meanwhile, politics in Saxony, such as budget cuts in the state parliament and cultural funding disputes, seem unrelated to the specific migration case.
