The Higher Administrative Court of Saxony (OVG) will reevaluate the controversial deportation of a Moroccan man residing in Chemnitz. In a recent decision, the Federal Constitutional Court in Karlsruhe determined that the OVG's ruling from July 2024 infringed upon the individual's fundamental rights, necessitating a reassessment of the case.
On July 11, the man was deported to his native Morocco despite an urgent suspension of the deportation by the Administrative Court in Chemnitz, which went unnoticed by federal police.
A few days after the deportation, the OVG ruled that the man not be returned to Germany. The legal standoff during this time also involved disputes over the denial of access to files requested by the man's lawyer. The Federal Constitutional Court deemed the OVG's decision to deny the complainant's request for access to the files as unjustified.
The Saxony Refugee Council branded the refusal to grant access to the files a scandal, stating that it represented a serious breach of the rule of law. The lawyer for the affected individual repeatedly sought access to the files and emphasized the implementation of the court order. However, the deportation proceeded regardless.
Inga Stremlau, representing the affected person, suggested that "prompt rectification of the significant rights violations would be appropriate, preferably through the expedited return of the affected party. If this is not immediately feasible, we recommend a straightforward and swift visa process as an alternative."
