OVG Faces Yet Another Case of Moroccan's Deportation - Moroccan Deportation Issue Resurfaces for OVG to Handle Once More

The Higher Administrative Court of Saxony (OVG) has been ordered to reevaluate the contentious deportation of a Moroccan resident from Chemnitz. In a recent ruling, the Federal Constitutional Court found that the OVG's decision from July 2024 infringed upon the man's fundamental rights, resulting in the nullification of the previous ruling and the case's return to the OVG for reexamination.

On July 11, the Moroccan individual was escorted out of Germany. Critics including local politicians raised concerns that an emergency injunction by the Chemnitz Administrative Court halting the deportation was not communicated to federal authorities, thus allowing the process to continue.

Only a few days after the deportation, the OVG declared that the man should not have been repatriated. The legal proceedings also entailed disputes regarding the denial of access to crucial files that the man's lawyer was entitled to. The Federal Constitutional Court has since determined that the OVG unreasonably refused the complainant's request for access to the files.

The Saxony Refugee Council deemed the refusal of access to the files as a significant breach of the rule of law. The Council's legal representative, Inga Stremlau, stated, "Given the substantial violations of fundamental rights, prompt rectification would be appropriate, preferably through the swift return of the affected person." If immediate repatriation cannot be carried out, she suggests a straightforward and expeditious visa process instead.

In light of the significant violations of fundamental rights, it is reported that timely resolution and rectification would be favorable, with the priority being the return of the affected person or facilitating a speedy visa application process.
