OVG Faces yet Another Moroccan Deportation Scenario - Moroccan Deportation Issue Resurfaces for OVG to Address

A Moroccan man, previously deported from Chemnitz in July 2024, will have his case revisited by the Higher Administrative Court of Saxony (OVG) following a decision by the Federal Constitutional Court. The OVG's initial ruling, which led to the man's deportation, was found to have violated his fundamental rights. As a result, the case will be resubmitted to the OVG for reconsideration.

Following the deportation on July 11, criticisms emerged regarding the failure to forward an urgent ruling by the Chemnitz Administrative Court, which had temporarily halted the deportation. After a few days, the OVG ruled that the man should not be returned, but this decision was later overturned by the Federal Constitutional Court due to the denial of the man's lawyer's request for access to relevant files without sufficient reason.

The Saxon Refugee Council deemed the denial of access to the files as a scandal, stating that it represented a serious attack on the rule of law. The lawyer for the affected individual expressed the need for "prompt reparation," ideally in the form of an accelerated return, or at the very least, an unburdened and expeditious visa procedure.

In light of significant violations of fundamental rights, the reparation process, if possible, should proceed swiftly. The reconsideration of the OVG will likely involve new examinations of evidence, reassessments of risk factors, and compliance with constitutional protections such as the right to asylum, protection from inhuman treatment, and due process rights.
