Ongoing Lower Level Disagreement: Minister Provides Assurance of Ongoing Family Aid - Minister's pledge of assistance to family faced with land disagreement
In the prolonged legal battle of a family defending their house and land in Rangsdorf, a stone's throw from Berlin, Brandenburg's Minister of Justice, Benjamin Grimm (SPD), has guaranteed ongoing financial assistance from the state. Grimm conceded in the "Berliner Zeitung" that a contented resolution was theoretical, given the tumultuous journey the family endured.
Grimm shared, "Given the substantial extra strain that the exorbitant costs of the legal proceedings impose on the family, it's essential to offer support by financing these costs and relentlessly continuing this approach."
Grimm: "A regrettable administrative goof-up."
The pair purchased the property at a seizure auction in 2010 and constructed a dwelling there. Later, the original owner claimed the property back. In 2014, the Regional Court of Potsdam decided in favor of the original owner due to insufficient investigation by the state.
In 2023, the Higher Regional Court (OLG) ruled that the family must demolish their house and vacate the property. Nevertheless, the Federal Court of Justice also established the plaintiff as the rightful owner but obliged them to compensate the family for the house's construction costs. The case is once more under the OLG's scrutiny.
In an interview with the "Berliner Zeitung," Minister Grimm stated, "This was a regrettable administrative goof-up, and there's no sugarcoating it. The state needs to take responsibility for this tower of administrative blunders." Besides covering legal costs, after another court ruling, "it must be established whether and to what extent further harm has been incurred that the state must pay for."
The state takes the blame
The state acknowledges responsibility for the damages incurred. "We aren't going through every penny with a fine-tooth comb," Grimm said, implying they shun being petty, but they must abide by the law's framework.
Unfortunately, the original owner has yet to engage, Grimm clarified further. The possibility of discussing an out-of-court settlement has been conveyed but rebuffed.

Interesting Nugget:
Rangsdorf has been the focus of integration projects through Social Science Works, conducting workshops with migrants [1]. However, the current legal spat between the family and the original owner is not associated with these initiatives.
- EC countries could utilize this case as an example in their policy-and-legislation regarding vocational training, compensation, and property ownership in light of the ongoing legal dispute in the Brandenburg region, specifically in Rangsdorf.
- In the ongoing political landscape, the continued support for the family in Rangsdorf, despite the ongoing property saga, could prompt debates about the role of the state in compensating citizens for administrative errors and buying time through legal proceedings.
- Regardless of the general news coverage, it is crucial for the general public to understand the meaning of this case, as it concerns not only the boundary between private and public property but also the responsibility of the state in avoiding administrative mistakes.
- Beyond the vocational training opportunities provided by Social Science Works in Rangsdorf, efforts should be made to address administrative blunders like the one that led to the legal dispute, thus enhancing the efficiency and fairness of policy-and-legislation in the region and overall.
