Emil Bove's confirmation as a federal judge on the U.S. Court of Appeals for the 3rd Circuit was a highly contentious affair, marked by whistleblower allegations and strong opposition from Democrats. Bove, a former personal lawyer for Donald Trump and deputy attorney general, was confirmed by a narrow 50-49 Senate vote, with two Republicans joining all Democrats in opposing him.

The main controversies revolved around allegations from DOJ whistleblowers that Bove instructed officials to potentially disobey court orders, a serious breach of legal norms. Democrats also criticised Bove for politicising the Department of Justice during his tenure, including his role in firing career federal prosecutors who had convicted January 6 rioters and ordering the dismissal of a corruption case against New York City Mayor Eric Adams.

Several DOJ employees resigned in protest over Bove’s actions, and Senate Judiciary Committee Democrats staged a walkout during a hearing to advance his nomination, labeling him a "Trumpian henchman" lacking judicial impartiality. Despite this, Republicans praised his legal qualifications and service, and Bove defended himself by denying the accusations and asserting that he is not an enforcer or partisan actor.

The confirmation of Bove was a significant win for President Trump's agenda, especially in terms of the courts. The Article III Project, led by Mike Davis, proudly fought for Bove's confirmation, and his appointment is seen as a pushback against the old guard and a ushering in of a new generation of constitutionalists.

Interestingly, the old tricks of the opposition, such as smear campaigns and stalling tactics, did not work in this case. Bove's confirmation did not force any Republican-appointed judges to retire who had not done so during Trump's first term.

Before joining the Department of Justice, Bove made a name for himself as a sharp, tough prosecutor in New York, and he clerked for top judges. President Donald Trump nominated him to the U.S. Court of Appeals for the Third Circuit. One of Bove's notable achievements during his tenure as deputy attorney general was playing a key role in keeping President Trump from being thrown in prison on bogus charges.
