U.S. Deports Salvadoran Man to El Salvador, Then Re-Arrests Him

Migrant Forced to Return to United States Following Expulsion from El Salvador - Migrant, previously expelled from the U.S., apprehended upon re-entry

You might have heard about the case of 29-year-old Kilmar Abrego Garcia, a Salvadoran national who found himself in a whirlwind of controversy. After living in Maryland on the U.S. East Coast for over a decade, he was deported to El Salvador in March 2025, despite a court order protecting him from deportation due to potential gang threats. Shockingly, this deportation was later found to be illegitimate by the U.S. Supreme Court, leading to his return to the U.S. to face federal charges.

Abrego Garcia's story has made international headlines, shining a light on the hardline stance of U.S. President Donald Trump towards irregular immigration.

Trump's administration admitted that Abrego Garcia's deportation was due to an "administrative error," but Trump himself labeled him as a member of the Salvadoran gang MS-13 and a "terrorist." However, a 2019 court decision had already annulled the order for Abrego Garcia's deportation due to the danger he faced in his home country. Following the U.S. Supreme Court's order in April, the government was instructed to facilitate Abrego Garcia's return to the U.S.

Justice Minister Pam Bondi claimed he was brought back to the U.S. due to an arrest warrant presented to Salvadoran authorities. She thanked Salvadoran President Nayib Bukele for his cooperation and noted that Abrego Garcia would face serious charges. Bondi accused Abrego Garcia of playing a significant role in a smuggling ring. He supposedly helped children, women, and MS-13 members enter the country illegally, and he was alleged to have smuggled firearms and drugs multiple times. After serving a potential prison sentence, Abrego Garcia would then be sent back to El Salvador, according to the justice minister.

Trump described him as "quite a villain" to journalists. Bukele declared that Trump had asked him to hand over the migrant to the U.S. "We cooperate with the Trump administration, and if they request the handover of a gang member for prosecution, we wouldn't refuse," Bukele explained on X.

Trump's deputy spokeswoman, Abigail Jackson, stated that Abrego Garcia's return had "nothing to do with his original deportation." She claimed that he was returning because new investigations had discovered heinous crimes committed in the U.S., for which only the American justice system could provide a fair trial.

One of Abrego Garcia's lawyers, Simon Sandoval-Moshenberg, accused the U.S. government of "abuse of power." Senator Chris Van Hollen welcomed Abrego Garcia's return to the United States, expressing relief that he would now have a fair trial in the U.S.

Abrego Garcia appeared in a Tennessee courtroom to face charges after his return. He was accused of two felony counts: transporting undocumented immigrants and conspiring with others to do so. These charges stemmed from a 2022 traffic stop in Tennessee, during which Abrego Garcia was found driving an SUV containing nine men lacking identification.

The charges against Abrego Garcia were related to human trafficking allegations, with Attorney General Pam Bondi emphasizing the gravity of these charges, particularly the involvement of children. Abrego Garcia's family and attorneys have denied the MS-13 gang affiliation claims, with his lawyers arguing that the trafficking charges are part of a broader political and legal standoff.
