Man Cleared in 'Lamborghini Case', Dealership's €150k Claim Dismissed

A man has been absolved of responsibility for a luxury sports car accident in Leipzig, October 2018, despite the car dealership's claim for over 150,000 euros in damages. The driver received the car as a gift from his wife through an agency for a half-hour joyride.

The driver lost control of the 580-hp car in the dark and rain, leading to the accident. He denied responsibility, blaming the passenger for activating the sports mode without turning it off. The Regional Court Leipzig dismissed the lawsuit, ruling that the defendant had not caused the accident intentionally or grossly negligently. The Higher Regional Court Dresden upheld this decision, rejecting the car dealership's appeal in the so-called Lamborghini case. Notably, any claim for damages had become time-barred due to the short six-month limitation period for rental agreements.

The driver is not liable for the total damage, with both the Regional Court Leipzig and the Higher Regional Court Dresden ruling in his favour. The car dealership's claim for damages exceeding 150,000 euros has been dismissed.
