"For more than a hundred days, the voices of my constituents have been silenced, as they've been denied a say in decisions that affect their lives directly," Libby shared in a statement. "Each vote cast on the legislative floor is a vote my constituents cannot reclaim."

Libby continued, "We are hopeful that the court will act swiftly to address the Democrats' ongoing breach of the Constitution and the suppression of divergent viewpoints, even as the broader case progresses through the appeals process."

State Rep Laurel Libby has appealed to the Supreme Court, citing the ongoing debate on transgender athletes in sports (our website).

The state's Democratic majority censured Libby for a social media post identifying a transgender athlete who emerged victorious in the girls' state pole vault competition in February. Libby filed a lawsuit against House Speaker Ryan Fecteau to overturn the censure, but U.S. District Court Judge Melissa DuBose ruled against her earlier this month.

The 1st Circuit Court of Appeals also declined Libby's position.

Libby previously told Digital she was ready to escalate her fight to the Supreme Court.

"Our appeal pleads for the court to rectify this misuse of power and reestablish that legislative leadership cannot abuse procedural maneuvers to exclude dissenting voices or disenfranchise entire communities," Libby explained to Digital.

"I remain optimistic that the court will recognize the gravity of the situation at hand: the sanctity of representative governance and the fundamental principle that no elected official or legislative leader should transgress the Constitution. The people of House District 90 deserve their rightful representation, and we are determined to recover it."

Libby has been unable to speak or vote on behalf of her 9,000 constituents in the Maine state legislature for two months now.

DuBose stated in her ruling that the censure "does not possess such extraordinary characteristics as to nullify the strong safeguard the courts have entrusted to legislative acts."
