Mahmoud Khalil forced to leave the U.S. and return to Algeria or Syria, as per immigration court decision.
In a ruling handed down on June 20, Immigration Judge Jamee Comans ordered the deportation of Mahmoud Khalil, a former Columbia University graduate student, to Algeria or Syria. The court's written decision, which denied Khalil's application for asylum, was based on allegations that he omitted information from his green card application.
Khalil, who has been a vocal advocate for Palestine and ending genocide, claims that the administration is attempting to deport him as retaliation for his exercise of free speech. He has accused the Trump administration of retaliation, stating that the tactics will not deter him from advocating for his people's liberation.
Judge Comans denied Khalil's motion for a waiver preventing his removal from the U.S. due to alleged misrepresentations in an application for an adjustment of status. The I-485 form, an application to register permanent residence or adjust status, was at the centre of the allegations. Judge Comee reaffirmed her ruling, stating that Khalil intentionally misrepresented facts on his I-485 form.
Khalil's lawyers have 30 days from the Friday order to appeal the decision to the Board of Immigration Appeals. However, the identity of Khalil's lawyer who will file the appeal has not been publicly disclosed.
It is important to note that this case is unrelated to the recent sentencing of the Navy's former second-in-command to 6 years for a bribery plot. Additionally, a chef is accused of robbing three San Francisco banks in one day, separate from the immigration and Navy cases mentioned.
Khalil was detained by Immigrations and Customs Enforcement in March and released in June. Since his release, he has continued to advocate for his causes, despite the impending deportation order. As the legal process unfolds, Khalil and his supporters remain hopeful that justice will prevail.
