Permanent Driver's License Revocations in Germany: What You Need to Know

In Germany, certain serious offenses can lead to a permanent revocation of a driver's license. This means the license is canceled and can only be reobtained by undergoing a complete reapplication process including tests and assessments.

The offenses that warrant a permanent revocation include:

  1. Endangering road traffic (Section 315c of the German Criminal Code)
  2. Illegal street racing (Section 315d of the German Criminal Code)
  3. Driving under the influence of alcohol or drugs (Section 316 of the German Criminal Code)
  4. Hit-and-run accidents involving serious injury or death
  5. Driving in a state of absolute intoxication (Section 323a of the German Criminal Code) related to the above actions

These offenses are considered among the most severe under German law. When convicted, the offender is deemed fundamentally unfit to drive (Section 69 Abs. 2 German Criminal Code), and the license revocation is effectively permanent.

However, there is a 10-year deletion period before reapplication, as per Section 29 Abs. 1 Nr. 3a of the Road Traffic Act (StVG)[1]. During this time, the offender cannot legally drive.

It's important to note that a medical-psychological examination (MPU) may be required to re-obtain a revoked driver's license. The costs to re-obtain a revoked driver's license can exceed 2,000 euros.

A driving ban can be imposed for various reasons, such as excessive speeding, running a red light, or violating the blood alcohol limit. The duration of a driving ban ranges from one to six months, depending on the severity of the offense.

Repeat offenders do not have the freedom to choose when to surrender their license during a driving ban, unlike first-time offenders. A revoked driver's license is time-limited and ends automatically upon expiration.

In addition, a court can revoke a driver's license permanently for reasons such as disregarding existing ban periods or using a car as a weapon. Medical reasons, such as physical or psychological conditions that make it impossible to drive a vehicle, can also lead to a lifetime driver's license revocation.
