Lawyers of Abrego Garcia persist in demanding that Trump administration officials face contempt charges

Kilmar Abrego Garcia's legal team is pushing to keep the civil lawsuit against the Trump administration alive, aiming to slap sanctions on officials for allegedly violating orders to bring him back from El Salvador, where he was erroneously sent earlier this year.

Post-civil deportation, the government has requested US District Judge Paula Xinis to put all deadlines on ice while they prepare a formal petition to close the case entirely. They argue that Abrego Garcia's return negates the case's necessity.

However, Abrego Garcia touched down in the US just two days after Xinis, an Obama appointee, granted his attorneys the right to ask for sanctions by June 11. The Maryland civil case was filed by Abrego Garcia and his family in late March to secure his return to the US.

In a court filing, Abrego Garcia's lawyers told Xinis that the government has acted in contempt and defiance towards the judiciary. They added that the government's reason for bringing Abrego Garcia back to face criminal charges in Tennessee, not Maryland, is sheer farce.

Federal charges for conspiracy to unlawfully transport illegal aliens for financial gain, and unlawful transportation of illegal aliens for financial gain, were filed in May and unsealed on his return. Abrego Garcia's lawyers assert that the court still needs to ensure that his case is handled as it would have been if he hadn't been illegally deported to El Salvador.

The deportation of the father of three in mid-March flagrantly flaunted a 2019 court order barring his removal to El Salvador because of fears that he would face gang violence there.

With the government's return of Abrego Garcia, the contempt aspect of the case is a matter of ongoing debate.
