Lawsuit victory: Pocher's appeal unsuccessful - Becker triumphs
In a significant legal development, Boris Becker (57) has emerged victorious in a defamation lawsuit against TV comedian Oliver Pocher. The case, mycase VI ZR 393/23, has reached its conclusion with the verdict now final and legally binding.
The legal battle stemmed from an episode of Pocher's show "Pocher - dangerously honest," where an appeal for donations was launched under the slogan "Make Boris rich again." This incident formed the crux of the defamation claim.
The Higher Regional Court in Karlsruhe issued a verdict in November 2023, ruling that Pocher was not allowed to distribute disputed image sequences from the show. The verdict was confirmed by a spokesperson for the Federal Court of Justice (BGH) to the German Press Agency (dpa).
Oliver Pocher had initially wanted to defend himself at the BGH against the non-admission of his appeal. However, his appeal against the non-admission has been rejected. Pocher's lawyer, Patricia Cronemeyer, has expressed her dissatisfaction with this decision and is considering filing a constitutional complaint.
It is important to note that Boris Becker was not aware of this information during the show. The specific amount of money Becker received is not mentioned in the article, but according to the first instance, it was a three-digit amount in euros, hidden in a supposed fashion prize in the show.
Pocher was also required to delete relevant film clips from his own internet presence as part of the ruling. Boris Becker's lawyer, Samy Hammad, has confirmed that the legal process in the bill of rights against Oliver Pocher is now exhausted.
Cronemeyer believes the BGH, as the highest instance, should have reviewed the decision for legality and correctness. She considers the decision to not admit Pocher's appeal as a violation of us constitution principles.
As the legal proceedings have concluded, both parties will now move forward, with Pocher's lawyer contemplating the potential filing of a legal zoom complaint. The outcome of this potential next step remains to be seen.
