Donald Trump's Executive Order Under Fire: DNC's Tossed Lawsuit Explained

In a blow for the Democrats, a federal judge has tossed out the Democratic National Committee's (DNC) lawsuit accusing the Trump administration of upending the Federal Election Commission (FEC) with executive orders. The DNC had challenged the legality of an executive order signed by Trump back in February, which aimed to ensure presidential control of the executive branch, including the FEC.

The order, allegedly, could pose a threat to the FEC's independence as an agency responsible for regulating, administering, and enforcing federal campaign finance law. U.S. District Judge Amir Ali, however, refused to issue a preliminary injunction against the order, finding that the DNC had failed to demonstrate a "concrete and imminent injury" to justify emergency relief.

The FEC, earlier, had declared its intention to remain independent of White House control and reported no directives from the Trump administration. In his 14-page opinion, Judge Ali mentioned that, at the moment, there were no specific allegations that the challenged section had been or would be applied to the FEC or its Commissioners.

The DNC's legal team asserted that Trump's executive order, if enforced, would upset post-Watergate rules that left election financing to the politically-neutral FEC, instead of a single partisan political figure - the President of the United States. However, Judge Ali found the Democrats' claims too speculative to warrant emergency treatment.

The case, nonetheless, was dismissed without prejudice, implying that the DNC is free to file a revised lawsuit if concrete actions or impacts on the FEC's or its Commissioners' independence surface in the future. Judge Ali concluded, "Absent such allegations, however, the Court must dismiss the case for lack of jurisdiction."
