In the wake of a recent court decision by the Administrative Court of Berlin, police officers administering border controls are grappling with legal uncertainties, according to the chairman of the Police Union. The ruling declared the rejection of three Somali asylum seekers as unlawful.

Police unions are demanding political backing and immediate legal clarity for officers, fearing potential accountability if a legal violation is established. The Federal Interior Minister, Alexander Dobrindt, has dismissed these concerns as far-fetched, stating that police officers have a clear directive.

However, if the directive is shown to be unlawful, police officers must express their dissent to avoid responsibility, according to the Police Union. Unionist Andreas Roßkopf argued that a written clarification is needed to ensure that officers, operating in this grey area, will not be held personally accountable if a legal violation is uncovered.

This controversy comes as police forces are already stretched thin at the borders, with many reserve officers deployed, duty schedules altered, overtime reductions suspended, and personnel from other stations sent to the border region. According to Roßkopf, this situation cannot sustain indefinitely.

The political implications extend beyond the police force. Continued policy violations could result in administrative court sanctions and public backlash, impacting the government's political approval. However, there is currently no specific written guidance for police officers regarding asylum seekers post the court ruling.
