Land Registration Process Altered in Belarus

In a notable development, President Alexander Lukashenko signed a new decree on July 14, 2022, introducing significant changes to the land registration procedure in Belarus. This decree, among other things, amends Decree No. 463 of December 26, 2017, "On Improving the Procedure for Expropriating and Providing Land Plots," and Decree No. 76 of March 2, 2021, "On the Issuance of Right-Certifying Documents."

The changes aim to streamline the registration process, particularly for self-occupied lands used for single-family residential houses, farming, collective gardening, dacha construction, and folk crafts. Under the new decree, these land plots can be registered without the need for developing projects for their withdrawal by January 1, 2028.

Moreover, the law mandates a mandatory pre-trial appeal of real estate registrar actions, ensuring a fair and transparent process for all parties involved. It also establishes a territorial principle of registration actions, enhancing efficiency and reducing bureaucracy.

The Unified State Register of Immovable Property will automatically record changes related to address changes of objects, personal data of citizens, identification data of business entities, and the transfer of property rights when an individual entrepreneur creates a commercial organization. This automation is expected to further simplify the registration process.

Citizens can now obtain registration certificates from the notary who issued the document, eliminating the need for additional visits to the real estate registrar. Organizations that have been provided with land for the construction and maintenance of operating multi-family residential buildings and housing and communal services facilities can also register plots without developing projects for their withdrawal by this time.

Notably, the law provides for a land amnesty, initially effective since September 1, 2022, which has been extended until January 1, 2028. This amnesty offers an opportunity for individuals and organizations to regularise their land holdings, potentially offering relief from penalties for past irregularities.

A law titled "On Amending Laws on State Registration of Immovable Property, Property Rights, and Transactions Therewith" was approved in December 2024, further solidifying these changes. The law makes changes to the area of improving the procedure for state registration of immovable property, property rights, and transactions therewith, establishing a mandatory registration of immovable property, property rights, and transactions within six months.

However, there is no detailed information in the search results regarding the land registration changes in Belarus from July 2022 to January 2028, including aspects like the simplified registration procedure or the extended land amnesty.
