Court Upholds Decision: Le Pen Loses Parliamentary Seat - Justice upholds dismissal of Marine Le Pen's conviction

The ruling, while the prison sentence is suspended for an appeal, immediately bars Le Pen from competing in public offices, especially the 2027 presidential election. This decision strips her of the opportunity to defend her seat, but she remains a Member of Parliament. However, her mandate as a Departmental Councilor has been revoked.

Le Pen announced her intention to challenge this ruling, delaying the implementation of the ban for the time being. Her legal team argued that this decision infringes on her ability to represent her constituents, even when the presumption of innocence still stands.

After the initial verdict in March, Le Pen promised to utilize all available legal options to permit her candidacy for the presidency. The appeal trial is set to conclude by summer 2026, during which the appellate court may uphold, override, or aggravate the sentence.

Courts found Le Pen and 23 other defendants guilty of misusing EU parliamentary assistant salaries between 2004 and 2016 to fund their political party, now called Rassemblement National (RN). The monetary loss was estimated at approximately four million euros.

  1. Marine Le Pen's ongoing legal team is vowing to dispute the court verdict that prevents her from participating in public offices, including the 2027 presidential election, claiming it restricts her ability to represent her constituents despite the presumption of innocence.
  2. The political fallout from the court's decision to bar Marine Le Pen from public office extends beyond her presidential aspirations; the verdict also results in the revocation of her mandate as a Departmental Councilor, yet her status as a Member of Parliament remains intact.
