Judge rules in Cristina Kirchner's favor, exempting her from paying a multimillion-dollar settlement for Vialidad.

The ongoing indemnification case against former Argentine President Cristina Kirchner, involving a claim of $1.125 billion, continues to be in the appeals process.

The latest development came on April 7, 2025, when Judge Bruno dos Santos declared the lapse of the instance in the Federal Civil and Commercial Court. However, this ruling can be appealed by the Argentine Government.

The case originated in 2018 when Javier Iguacel, then head of the National Highway Administration, filed a civil lawsuit against Cristina Kirchner and others in relation to the Vialidad criminal case.

The inactivity that led to the lapse of the instance occurred during the presidency of Alberto Fernández, in which Cristina Kirchner served as vice president. Specifically, from the resumption of the process on March 17, 2023, until March 28, 2023, the National Directorate of Vialidad had been completely inactive, fulfilling the legal six-month inactivity period.

Judge Dos Santos' decision implies the conclusion of the civil judicial process due to procedural inactivity. The judge ruled that the penalty is for Vialidad's negligence, which ignored the course of its claim, and that this measure aims to prevent the indefinite duration of processes when the interested parties abandon their claims.

However, on November 28, 2024, Cristina Kirchner's defense appealed this decision, arguing it was "manifestly arbitrary". But on December 3, 2024, the judge denied the appeal.

It's important to note that Cristina Kirchner is currently serving a six-year prison sentence and must pay the seizure of her assets up to $530 million in a separate criminal case.

For those interested in the most up-to-date details, monitoring official court communications or reliable Argentine legal news sources would be advisable, as these cases can evolve with further judicial decisions and procedural developments.

In a related development, on December 22, 2022, the Supreme Court of Justice of the Nation attributed the competence of this matter to the Federal Civil and Commercial jurisdiction.

More recently, on March 10, 2023, Carlos Santiago Kirchner presented a "new fact": his acquittal in the Vialidad criminal case on December 6, 2022, and requested to be excluded from the case.

As of now, the appeals process remains ongoing, and no final resolution has been reached yet. For Hernán Cappiello, Cristina Kirchner has filed a new complaint in the Federal Justice, but this fact is not explicitly stated in the text.
