Judge Halts Trump-Initiated FTC Actions Against Liberal Media Watchdog Due to Retaliation Concerns

In a significant ruling, U.S. District Judge Sparkle L. Sooknanan has granted a preliminary injunction against the Federal Trade Commission (FTC) in its investigation of Media Matters for America. The judge's decision suggests that the FTC's probe could constitute retaliation for constitutionally protected speech under the First Amendment.

The FTC's investigation, which began in May 2025, was focused on allegations of improper coordination between Media Matters and advertisers. However, the liberal advocacy group contends that the FTC's civil investigative demand (CID) was excessively broad and lacked proper statutory authority. Media Matters has also alleged violations of the First and Fourth Amendments and sought to block the investigation through legal action filed in June 2025.

The FTC's investigation has been halted pending resolution of these First Amendment retaliation concerns. An FTC spokesperson did not immediately respond to a request for comment about the court order.

Media Matters has been a vocal critic of Elon Musk's X social network, publishing numerous reports about the prevalence of violent and hateful posts on the platform. This criticism led Musk to sue Media Matters in response.

The court's ruling has been welcomed by Media Matters as a symbol of effective resistance against the Trump administration. Angelo Carusone, the president of Media Matters, stated that the decision demonstrates the importance of fighting against intimidation from the Trump administration. He emphasized that this case is a critical test for whether the courts will allow any administration to bully media and non-profit organizations through illegal abuses of power.

Carusone also pointed out that the injunction serves as a reminder that some advertisers have fought back against Musk, arguing that he has resorted to legal and political maneuvers to win back business lost in the free market. The court battle between Media Matters and the FTC is likely to continue.
