Germany's Constitutional Court Appointment Dispute: A Political and Ideological Battle

A dispute over the appointment of judges for Germany's Federal Constitutional Court has taken a political turn, with ideological and ethical disagreements at the heart of the controversy. The nomination of Frauke Brosius-Gersdorf, proposed by the Social Democratic Party (SPD), has been met with resistance, particularly from the CDU/CSU alliance.

The disagreements stem from Brosius-Gersdorf's progressive views on abortion and her support for mandatory COVID-19 vaccinations. Conservatives within the CDU/CSU have raised concerns about her suitability, citing plagiarism allegations and questioning whether her liberal stances may undermine the court's credibility.

The election of three judges for the Federal Constitutional Court was temporarily suspended in the Bundestag on July 11 due to the resistance within the Union faction against Brosius-Gersdorf's nomination. This decision has caused tensions within the coalition government, with Brandenburg's Minister President, Dietmar Woidke, appealing for all parties to reach an agreement.

Woidke has proposed a restart of the procedure for filling the three positions at the Federal Constitutional Court, suggesting the inclusion of the opposition parties, excluding the AfD. He recommends involving the Left party and the Greens early on, as they are necessary for a two-thirds majority. Woidke believes that the factions in the Bundestag should find a solution quickly to the deadlocked dispute.

The Greens supported delaying the vote for all candidates, arguing the controversy threatens the court’s impartiality. Meanwhile, SPD and the Greens have condemned the CDU/CSU's actions as politically motivated and harmful to the judiciary’s reputation. Chancellor Friedrich Merz, from the conservative camp, defended Brosius-Gersdorf against harsh attacks, labeling much criticism as biased and unacceptable personal defamation.

Influential figures such as Bavarian bishops have called for upholding human dignity in court appointments, implicitly opposing Brosius-Gersdorf’s views on abortion, which they find constitutionally controversial and ethically problematic. This broad opposition reflects the polarized nature of the debate, highlighting ideological divides over fundamental rights interpretation and the role of a constitutional judge.

The candidates in question, Brosius-Gersdorf, Kaufhold, and Spinner, could potentially stand for election in a new procedure, according to Woidke. However, the CDU/CSU parliamentary group leader Alexander Hoffmann had proposed drafting a new judicial package, which was met with resistance from the SPD and Greens.

The dispute exposes wider political and social cleavages in Germany’s ruling coalition and public discourse on abortion and constitutional protections. As the debate continues, it remains to be seen whether a compromise can be reached to fill the vacancies at the Federal Constitutional Court.
