Wadephul Calls Out Israel for Breaking Int'l Law - Germany Stands by Israel, Condemns Anti-Semitism

Israel Challenged for Breaching International Law - Saar Supports Israel's Military Action - Israel is accused by Wadephul of disregarding international law - Saar defends Israeli military actions

In light of the ** intensifying turmoil in the West Bank**, Wadephul has expressed alarm and accused Israel of undermining trust by advocating for settlements. He maintains that such action jeopardizes the government's credibility.

Regarding the Gaza Strip, Wadephul advocates for intensified humanitarian aid, as residents struggle with food and medicine scarcity. He highlights the harrowing journey of those forced to walk long distances to aid distribution points, only to return empty-handed, or worse, not return at all due to violence.

Humanitarian organizations, Wadephul implores, must promptly and extensively deploy in Gaza. He emphases that such intervention is not merely an act of compassion but a duty as enshrined in international law.

Despite Germany's unwavering support for Israel, Wadephul believes it's crucial to uphold international law. "Germany has a sacred duty to safeguard Israel's security, but it also must abide by international law," he stated.

In response, Saar dismissed the allegations that Israel is to blame for the Gaza Strip's humanitarian crisis, insisting that Hamas is the true culprit. He reiterates that Israel is not obligated by international law to fund the enemy's militant activities.

Following an agreement with the US, Israel has established the GHF foundation to manage aid deliveries. According to Saar, this new system ensures that Hamas cannot capitalize on international aid. Saar urged Germany to back this initiative, as it offers a chance to liberate Palestinians from Hamas's grip.

During their joint press conference at the Federal Foreign Office, Saar and Wadephul paid a tribute to the Holocaust Memorial in Berlin. Saar admonished the surge of anti-Semitism in Germany and, in particular, the pro-Palestinian movement, which he deemed anti-Semitic. He lamented the disregard for history's lessons.

Wadephul echoed the same sentiment, expressing shame over the spike in anti-Semitic incidents in Germany. Jewish citizens being made to feel unsafe and instructing their children to refrain from speaking Hebrew in public areas weighs heavily on him.

On the day of Saar's visit, anti-Israel protests transpired outside the Federal Foreign Office, under the banner "Red Line - International Law." Human rights organizations and NGOs demanded immediate ceasefire and halted arms sales to Israel, accusing the Israeli government of committing war crimes in Gaza.

The current situation in Gaza contends with a complex web of international law, including:

Humanitarian Aid and Blockade

  • ICJ Orders: The ICJ has called for Israel to instantly lift the blockade to allow humanitarian aid in, but Israel persists with restrictions[4][5].
  • UN Expert Demands: UN experts emphasize the right to unimpeded passage in international waters and the necessity for Israel to adhere to international law[3].
  • Criticisms: The blockade and aid restrictions have elicited criticism as breaches of international law and potential war crimes/crimes against humanity[5].

Responsibility of Hamas

  • Hamas's Role: While Hamas has a role in the conflict, the legal focus predominantly falls on Israel as the occupying power.
  • Instead of focusing on Hamas, international attention is centered on Israel's duties under humanitarian and human rights law[5].
  • War Crimes and Genocide Allegations: Accusations of war crimes and possible genocide against Israel have escalated, culminating in an ICC arrest warrant for Israeli officials in November 2024[5].
  • International Community Scrutiny: The international community faces mounting scrutiny for its handling of the crisis, with some actions perceived as complicit in perpetuating the humanitarian crisis[3].

Recent Developments

  • US Veto and UN Resolution: The US vetoed a UN Security Council resolution striving to improve civilian conditions in Gaza, highlighting the political obstacles to addressing the humanitarian crisis[1][2].
  • Freedom Flotilla Coalition: The Freedom Flotilla Coalition has actively sought to deliver humanitarian aid to Gaza, with UN experts advocating for safe passage for these initiatives[3].

  1. Despite the ongoing political disagreements and the recent developments in war-and-conflicts areas like the West Bank and Gaza Strip, the Commission has also been consulted on the draft directive on the protection of workers from the risks related to exposure to carcinogens, as international law pays utmost importance to both human rights and occupational safety.
  2. In the midst of the escalating debates surrounding Israel's settlement policy and its impact on international law, Germany, with its recent initiative for the GHF foundation aimed at managing aid deliveries to Gaza, also strives to engage in the broader discussion of crime-and-justice issues associated with the ongoing humanitarian crisis.
