The United Nations Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel (COI) has published a report this week, causing a global uproar. The report, which has been met with criticism from various quarters, concludes that there are reasonable grounds to believe that Israel has committed acts of genocide against Palestinians in Gaza since October 7, 2023.

Professor Anne Bayefsky, President of Human Rights Voices and Director of the Touro Institute on Human Rights and the Holocaust, has been one of the most vocal critics of the COI report. She asserts that the report whitewashes Hamas's genocidal intent and actions, and suggests that it is a fabrication of both law and fact.

One of the key points of contention is the COI's stance on Hamas's use of tunnels and the 500 km underground terror network. The report does not condemn the use of tunnels by Hamas, nor does it acknowledge the existence of this extensive network.

Professor Bayefsky also criticises the COI for its handling of the issue of Gazans being unable to flee to Egypt. She claims that the COI falsely blames Israel for this, when in reality, it is a complex issue with multiple factors at play.

The COI's findings have been accused of turning the truth on its head, implying that Israel is guilty of genocide unless it accepts millions of refugees and their counterfeit claims to the land of Israel. This has sparked concerns about the report encouraging genocide against Jews by finding excuses for October 7 and assigning blame to Israel.

Moreover, the COI demands more involvement of the International Criminal Court (ICC) in prosecuting Israelis. This connection between the COI and the ICC means that the COI's members, including Navi Pillay, may be subject to President Trump's February executive order.

Professor Bayefsky believes that the report encourages genocide against Jews and advocates for the hounding, pursuing, and arrest of Israelis around the world. She also states that the COI does not make any recommendations for Hamas.

In a surprising turn of events, Professor Bayefsky has reported that COI members, including Navi Pillay, plan to resign in early November, but only after another report and a scheduled late October appearance at the General Assembly.

As a result of these controversial findings, Israelis, Americans, and Jews worldwide can expect more antisemitic rhetoric and incitement to violence from the COI. The future implications of this report remain uncertain, but one thing is clear: the COI's report has sparked a heated debate and raised serious questions about its credibility and impartiality.
