In a trial that took place in Düsseldorf, Germany, two Syrian nationals were acquitted of charges related to participating in murder and war crimes, despite their membership in the Islamic State (IS) in Damascus, Syria during the Syrian civil war.

The 35-year-old defendant was part of a special unit within the IS, while the 40-year-old defendant held leadership positions and commanded a checkpoint in a Damascus neighborhood. Both defendants initially joined the IS in 2013.

The court took into account that both defendants have no criminal record in Germany. However, the court considered the brutal, cruel, and inhuman methods of the IS as aggravating factors. The IS, a militant group that emerged during the Syrian civil war, controlled large areas of Syria and neighboring Iraq at times, and was responsible for numerous attacks, including some in Germany.

Despite the prosecution's suspicions that the defendants were personally involved in the abduction and execution of IS prisoners, this could not be proven. The court acquitted the two Syrians of these charges.

The court did not provide a specific prison sentence for the defendants, but they were sentenced to six and seven years in prison respectively for their membership in the IS in Syria. The verdict is not yet final, and an appeal to the Federal Court of Justice in Karlsruhe is possible.

Followers of the IS carried out numerous attacks, including in Germany, but the two convicted men in Düsseldorf for their membership in the IS in Syria are not publicly disclosed in the search results. The crimes for which the defendants are being tried are already in the past.

The 40-year-old defendant initially operated covertly, gathering information for the Islamic militant group, before becoming one of the IS leaders in Damascus. The other defendant, the 35-year-old, was part of a special unit within the IS.
