The Office of Special Counsel (OSC) is currently investigating former special counsel Jack Smith over allegations that he unlawfully influenced the 2024 election by bringing criminal charges against Donald Trump before the election, potentially violating the Hatch Act, which restricts political activities by federal employees.

Senator Tom Cotton, who chairs the Senate Intelligence Committee, has been at the forefront of these allegations. He has accused Smith of using far-fetched and aggressive legal theories to prosecute the Republican nominee for president, with the intention of affecting the election outcome to benefit Democrats.

The investigation was sparked by Smith's indictment of Trump in August 2023, which included charges related to retaining classified documents and conspiring to overturn the 2020 election results. Notably, this indictment occurred prior to the 2024 presidential election.

Cotton has also accused Smith of speeding up trial dates and publishing information "with no legitimate purpose" in four instances during his tenure. He argued that the trial dates and jury selection period for Trump's case were expedited, with the jury selection period scheduled just two weeks before the Iowa Caucuses in 2024.

The investigation is unusual because it targets a federal prosecutor for potentially using their official capacity to influence an election. The OSC, tasked with ensuring federal employees aren't conducting partisan political activity under the guise of their federal employment, is well-situated to determine whether Smith broke the law.

Notably, after Trump’s victory in the 2024 election, on November 25, 2024, Smith announced his intention to drop all charges against Trump, further fueling debate on whether his earlier prosecutorial actions were politically motivated.

The implications of this investigation are significant. If found to have violated laws restricting federal employees from partisan political activity, Smith could face consequences. The investigation could also potentially undermine the perceived independence of the Justice Department and influence future prosecutorial conduct in politically charged cases.
