The referral, led by Bill Pulte and Ed Martin, the leader of the Justice Department's Weaponization Working Group, claims that James 'appears to have falsified records' to meet lending requirements and secure favorable loan terms for the property.

However, James and her attorney, Abbe Lowell, have contested these allegations, stating that the contested document was a mistake and that it was the only document related to the purchase of the home that indicated the primary residence designation. The allegations center on a document that incorrectly shows the property as James' primary residence.

Despite a grand jury hearing evidence, prosecutors have so far declined to seek an indictment. This has led to the investigation into James being at a standstill, as there is not enough clear and convincing evidence to show that James knowingly made false statements to a financial institution for a better mortgage rate.
