Investigating Fairfax County Prosecutor: Victims Urged to Share Their Experiences by AG Miyares
Fairfax County Commonwealth’s Attorney Steve Descano is currently under investigation by Virginia Attorney General Jason Miyares, following public and official concerns about his handling of criminal cases. The investigation was initiated by Governor Glenn Youngkin in early August 2025, due to concerns that Descano has failed to protect the public adequately.
The investigation stems from a viral video showing a repeat offender attempting to abduct a young girl at Fair Oaks Mall. The accused had a long criminal history in Fairfax County, with over 30 cases, many of which were not prosecuted or resulted in lenient plea deals. Critics, including law enforcement and victims’ advocates, accuse Descano of being too lenient, failing to prosecute many serious crimes, and prioritizing a more reformist than prosecutorial role.
Descano’s office reportedly dropped or declined to prosecute charges in multiple cases involving this individual, including serious offenses like malicious wounding. Lt. Gov. Winsome Sears publicly called for his recall, accusing him of dereliction of duty for releasing dangerous offenders into the community.
Attorney General Miyares has emphasized accountability and promised to report findings to the public once the investigation concludes. As of August 2025, no formal charges or disciplinary actions against Descano have been announced, but the inquiry continues amid significant political and community pressure.
In addition to the investigation into Descano's handling of criminal cases, Miyares has also urged five Northern Virginia school districts to repeal their bathroom and locker room policies based on gender identity. He believes that these policies have disastrous consequences and go against the common-sense policies advocated by Governor Youngkin.
Miyares has shared stories of victims who have shared horrific stories of not being told their case was being dismissed or charges being dropped. He believes that Descano views himself as a social worker, not a prosecutor, which he believes breaks down the criminal justice system.
It's worth noting that the investigation does not seem to be related to the Loudoun County School Board meeting to discuss transgender bathroom and locker room policy. The five school districts have until next Friday to decide whether to drop those policies or challenge the U.S. Department of Education.
Miyares has also stated that if he were to take someone back in time to 2005, they would not believe that political leaders and school boards would think it's okay for biological boys to be in women's sports teams and locker rooms.
