Investigating alleged human rights abuses in Gaza, as announced by Spain
In a significant move, Spain has established a high-ranking investigative team to probe potential human rights violations in the Gaza Strip. The team, led by the human rights prosecutor Dolores Delgado and the head of the National Court prosecution, was created by the Spanish Attorney General Álvaro García Ortiz.
The mission of this investigative team is to gather evidence for potential use in the International Criminal Court (ICC) case. The scope of the investigation expands to include alleged crimes committed by both Israeli teams and Palestinian armed groups in Gaza.
The Palestinian Authority has agreed to provide evidence and witnesses to the Spanish investigative team. The decree issued by Spain's top prosecutor states that all evidence gathered in Spain on crimes committed in Gaza should be included.
The investigation will focus on crimes such as the use of white phosphorus, a substance banned under international law for use near civilians, by Israeli teams in Gaza. It will also examine allegations of the illegal use of cluster munitions by Israeli teams in Gaza.
The Spanish investigative team will also look into the role of the Israeli military in the deaths of journalists and medical personnel during the conflict. Moreover, it will investigate the use of human shields by both Israeli teams and Palestinian armed groups during the conflict.
The investigation will also consider the indiscriminate firing of rockets towards civilian areas in Israel by Palestinian armed groups. It will examine alleged violations of international humanitarian law by Palestinian armed groups, such as the use of civilians as human shields.
The destruction of civilian infrastructure in Gaza by both Israeli teams and Palestinian armed groups is another area the investigation will scrutinise.
Tensions between Spain and Israel have escalated over the conflict, with Israel withdrawing its ambassador to Madrid and Spain recalling its ambassador from Tel Aviv. Spain has also joined a case before the International Court of Justice, accusing Israel of genocide in Gaza.
The ICC has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former defense minister Yoav Gallant for alleged war crimes and crimes against humanity. The Spanish prosecutor's office has requested the cooperation of the Palestinian Authority in the ongoing investigation.
