Individual removes Israeli emblem: Authority probes potential security measures
In Berlin, Germany, a 51-year-old individual found himself under investigation after an incident involving the desecration of an Israeli flag outside the New Synagogue in Berlin-Mitte on Oranienburger Street.
The man allegedly tore down an Israeli state flag and threw it on the ground, an act that is punishable under German law. According to the German Criminal Code, damaging or reviling foreign state flags in public is illegal, with penalties including fines and imprisonment of up to three years.
The New Synagogue, opened in the mid-19th century, is Berlin's largest Jewish house of worship and is now used for exhibitions, among other things. It is also where Jewish services are held. The Foundation New Synagogue Berlin - Centrum Judaicum commemorates the history and fate of Berlin's Jews.
The incident occurred in Berlin, and due to the apparent political context, the Police State Protection Department of the State Criminal Police Office is responsible for the investigation. The police have recorded the personal details of the 51-year-old and have announced that he is under investigation for violating foreign state flags and emblems, and for trespassing.
It is worth noting that the German legislation covers flags both officially displayed by foreign states and flags used unofficially or in private contexts. Desecration acts include burning, tearing, or any form of damage or insult to the flag. Protection has been extended to European Union flags as well under §90c StGB.
This legal framework balances flag protection with constitutional rights like freedom of expression, but serious acts of desecration can nonetheless result in prosecution and penalties. The man, who was found to have a house ban, was allowed to leave the scene but remains under investigation.
