Georgian Opposition Leader Elene Khoshtaria Refuses Bail and Court-Appointed Lawyer

In a dramatic turn of events, Elene Khoshtaria, the leader of the opposition Droa party in Georgia, has rejected a court ruling granting her release on GEL 5,000 bail. Khoshtaria's letter, shared by Team GT, explains her refusal to pay bail and her stance on the court-appointed lawyer.

Khoshtaria was arrested on September 15 and charged under Part 1 of Article 187 of the Criminal Code of Georgia for allegedly damaging election banners. The investigation was launched at the request of representatives from the ruling Georgian Dream-Democratic Georgia party.

At the hearing, Khoshtaria refused legal representation and declined the right to a defence. She also rejected the assistance of a treasury lawyer appointed by the court. In her letter, Khoshtaria emphasizes that paying bail would not equate to real freedom.

Khoshtaria considers her imprisonment as illegal, and she mentions that many others who are free in spirit are also illegally detained. She assures her supporters that imprisonment is not the end of the struggle, and she promises a triumphant victory.

However, Khoshtaria's letter does not provide any new information regarding the postponement of her hearing. The decision on the probation sentence for Khoshtaria was made by Judge Giorgi Kapanadze, and the trial was held on September 18, 2025. The charges pertain to the damage or destruction of property resulting in significant harm, an offence punishable by one to five years in prison.

It is worth noting that Khoshtaria refused to meet with a human rights defender who visited her in detention. The court ruling was issued by Judge Arsen Kalatozishvili, but the letter does not mention any new charges or investigation against Khoshtaria. Furthermore, the letter does not indicate any change in her stance on meeting with a human rights defender or accepting legal representation or the appointed treasury lawyer.

Khoshtaria's letter does not mention any specific lies or farces that she refers to in her statement. She states that she will not pay for the gesture of opening the prison door, as she cannot call others to fight while participating in lies and farces.

As the situation unfolds, Khoshtaria's stance continues to garner attention and support from her followers. The future developments in this case are eagerly awaited by both supporters and critics alike.
