Impact of Cannabis Legalization on Road Transport Operations

In a bid to raise awareness about the legal consequences of driving under the influence of cannabis, the ACE District Board Ingolstadt is hosting a club evening on July 17, starting at 7 pm. The event, to be held at TSV Nord, Wirffelstraße 25 in Ingolstadt, is open to all interested parties and will feature a presentation by Birgit Goßl, a trusted lawyer from Ingolstadt, on current rulings in the field of traffic law.

Even though recreational cannabis use has been decriminalized in Germany, driving under the influence of THC remains strictly prohibited. The legalization of cannabis for private use does not exempt drivers from severe consequences for driving with THC above the legal limits.

Germany enforces strict penalties for driving under the influence of cannabis, even after legalization. The key takeaway: cannabis use is legal in private, but driving with THC above 3.5 ng/ml (general drivers) or any detectable amount (under 21/probationary) risks fines, license suspension, mandatory medical-psychological assessment (MPU), and even criminal charges for severe or repeated violations.

The table below summarizes the consequences by offense type:

| Offense Type | Penalty Scope | Possible Consequences | |-------------------------------|--------------------------------------|------------------------------------------------| | First-time, low-level | Administrative | Fine, points, possible MPU | | Repeat or dangerous offense | Criminal | Heavier fines, license suspension, MPU, jail? | | Under 21/probationary license | Zero tolerance | Fines, license suspension, MPU | | Accident involvement | Case-by-case (impairment suspected) | MPU, possible license suspension or revocation |

Attendees will have the opportunity to try navigating with cannabis goggles, which simulate the effects of consuming three to four joints. ACE's perspective is that cannabis consumption and driving do not mix, including for means of transportation like bikes.

Interested parties can contact Ursula Hildebrand via email at [email protected] or by phone at 0151/ 67342601 for any questions beforehand. The event is focused on discussing the legal situation of cannabis consumption and driving. Non-members are welcome to attend.

Sports enthusiasts should be mindful that driving under the influence of cannabis, even after legalization, can lead to severe consequences. For instance, after consuming cannabis, attempting to bike, skate, or participate in any other sport could result in legal penalties due to impaired reaction times.
