Husband of Emilie Kiser reportedly wagered $25 on an NBA game prior to their 3-year-old son's tragic drowning, according to police statements.
No Charges Filed Against Brady Kiser in Son's Drowning Incident
The Maricopa County Attorney's Office has decided not to pursue child abuse charges against Brady Kiser, the father of Emilie Kiser's 3-year-old son, Trigger, who died in a drowning incident in the family's backyard pool on May 12.
According to the report, Trigger was unsupervised while playing around the unsecured pool and could not swim. Surveillance footage showed that he was unsupervised for at least nine minutes before Kiser found him in the water, unconscious. However, the report does not provide the exact time when Trigger was found or the duration of his unconsciousness.
The Chandler Police Department initially recommended child abuse charges against Kiser, citing that he knew the pool was uncovered and that his son did not know how to swim. The police suggested one count of Child Abuse, a Class Four Felony.
However, after reviewing the evidence, including the surveillance video, the county attorney’s office determined that the case did not meet the high legal standard to prove beyond a reasonable doubt that Kiser’s failure to perceive the risk was a gross deviation from reasonable care.
