High Court of Madhya Pradesh reprimanded for proceeding with case in defiance of Supreme Court injunction

In the ongoing legal battle between the Registrar, M.P. Paramedical Council and the Law Students Association, the Supreme Court of India has expressed its disapproval over the Madhya Pradesh High Court continuing to hear the case despite a stay order.

The case, initially under the jurisdiction of the Supreme Court, was later taken up by the Madhya Pradesh High Court. However, the Supreme Court has stayed an earlier order of the Madhya Pradesh High Court, which halted recognition and admissions in paramedical colleges and allowed admissions to continue. The Supreme Court questioned the locus standi of law students to file such a petition.

Despite this stay, the Madhya Pradesh High Court continued to look into related matters such as alleged false statements (perjury) by the Paramedical Council and issues regarding illegal affiliation and recognition of colleges. This continuation appears to be due to the High Court's need to address broader public health concerns and verification of facts related to the quality and legality of paramedical college recognition.

However, recognizing the Supreme Court's position, on August 20, the Madhya Pradesh High Court adjourned the petitions sine die, effectively pausing proceedings until further notice. The interim application for initiating perjury proceedings was declared "cannot go on" in view of the apex court’s stay.

The Supreme Court's stance on the matter underscores the need for respecting the jurisdiction of higher courts. The case is related to alleged irregularities in the recognition and admissions of paramedical colleges in Madhya Pradesh. The Supreme Court of India emphasizes the importance of judicial propriety in this matter.

The Madhya Pradesh High Court's initial continuation was to probe allegations beyond the stay’s scope, but ultimately it respected the Supreme Court's order by adjourning the case sine die. The Supreme Court has previously expressed surprise over the Madhya Pradesh High Court continuing to hear this case.
