High Court of Madhya Pradesh announces Sessions Judge's decision to drop charges against an accused was erroneous, orders an investigation.
The Madhya Pradesh High Court has recommended an inquiry against Additional Sessions Judge Vivek Sharma for dropping serious charges against Roop Singh Parihar in a land embezzlement case. The case, known as Roop Singh Parihar vs The State of Madhya Pradesh, has been under investigation since last year.
The case alleges that over ₹25 Lakh was transferred to eight persons, including Parihar and his wife, in a land acquisition matter. The original payment was over ₹6.55 lakh. However, no evidence or supporting documents have been presented showing that Parihar's land was acquired by any public or governmental authority.
Parihar, who is a computer operator in the office of the Land Acquisition Officer, is alleged to have forged the orders of the Collector. The Court found that the Additional District and Sessions Judge erred in discharging Parihar of most charges, including sections 409, 420, 467, 468, and 471 of the Indian Penal Code (IPC). The Court declined to grant bail to Parihar due to his manipulation of orders and forged documents.
Advocates Rabindra Kumar Mishra and Shivendra Singh Raghuvanshi represented Parihar, while Advocate Abhishek Bhadoriya represented the State. The State argued that Parihar is the main accused in the case and that he was not one of those farmers whose land was to be acquired.
Justice Rajesh Kumar Gupta of the Madhya Pradesh High Court stated that Judge Vivek Sharma appeared to have done this to ensure the accused gets bail. The High Court directed that a copy of the order be sent to the Principal Registrar (Vigilance), High Court of Madhya Pradesh for conducting an inquiry and taking disciplinary action against Judge Vivek Sharma.
As the investigation continues, many perpetrators are yet to be identified in the case. It is unclear at this time whether any further action will be taken against Judge Vivek Sharma or Roop Singh Parihar.
