In a significant move towards enhancing transparency and trust in the courts, Kazakhstan is launching new cassation courts in Astana, effective from July 1, 2025. The new courts form part of a broader systemic judicial reform aimed at optimising management processes, improving judicial proceedings, and introducing advanced digital technologies.

These specialised courts, independent in their operation, will handle criminal, civil, and administrative cases separately, thus providing a more effective platform for citizens and businesses to defend their rights and legitimate interests. The courts will serve as a new instance in the judicial system, acting as a higher review authority that will focus on ensuring professionalism, integrity, and impartiality in legal decisions.

Each of the three types of cassation courts in Astana - Civil, Criminal, and Administrative - will be staffed with 90 judges, all appointed by the President. The new courts will provide an additional layer of judicial oversight, strengthening public confidence in the justice system.

With the introduction of the cassation courts, cassation appeals will replace petitions for review of judicial acts. For administrative cases, the plaintiff will have the option to choose the court of jurisdiction. This change aims to eliminate corruption risks and further enhance trust in the courts.

The Supreme Court will also ensure compliance with the law in the administration of justice. In addition, it will assume the responsibility of studying and summarising judicial practice. Only local and cassation courts will directly administer justice.

The new cassion courts are part of a broader effort to transform the judicial system in Kazakhstan, with the aim of creating a more effective, transparent, and just legal system. Uniform rules for cassation review have been introduced for all types of proceedings, ensuring consistency and fairness in the adjudication process.

In summary, the new cassation courts perform the role of a higher judicial review body that operates independently across three key legal domains to enhance access to justice, improve the quality of judicial decisions, and support ongoing judicial reforms aimed at a more effective, transparent, and just legal system.
