Harvey Weinstein's sentencing hearing might take place next month, but it hinges on the resolution of an outstanding rape charge, which could potentially lead to a retrial.
Harvey Weinstein, the disgraced Hollywood producer, is facing a potential third trial in Manhattan on a rape charge, nearly five years after his initial sex crimes case began. The trial, which could see Mann testify again, is yet to be scheduled, leaving Weinstein's possible sentencing on September 30 in limbo.
In June 2025, a jury convicted Weinstein of a criminal sexual act against Miriam Haley but acquitted him of another charge and failed to reach a verdict on a third-degree rape charge involving Jessica Mann. Prosecutors are ready to proceed with a third retrial on this unresolved rape charge.
Weinstein's lawyer, Arthur Aidala, believes it's on prosecutors to resolve the rape charge. Manhattan District Attorney Alvin Bragg has expressed a desire to retrial Weinstein on the Mann rape charge. Assistant District Attorney Nicole Blumberg will ask Mann and other witnesses about their availability for a trial in the fall.
The timing of the trial is uncertain, with prosecutors initially requesting a January start, which was deemed too far away by the judge. Judge Curtis Farber proposed a fall start instead to avoid a January date that conflicts with another trial.
In 2020, Weinstein was convicted of raping Jessica Mann and forcing oral sex on Miriam Haley. This spring, a new jury convicted Weinstein again of sexually assaulting Haley and acquitted him of doing the same to another woman, one-time model Kaja Sokola.
Mann has testified that she had a consensual, on-and-off relationship with Weinstein, but that she told him "I don't want to do this" as he cornered her in a hotel room. The rape charge is punishable by up to four years in prison, while the charge against Weinstein carries a possible sentence of up to 25 years in prison.
Weinstein, who was seen in court this spring in a wheelchair while wearing a blue suit and black-rimmed glasses, is currently appealing his 2022 conviction in Los Angeles, where he was sentenced to 16 years in prison. Despite his ongoing legal battles, Weinstein has stated his commitment to fighting the rape charge at another trial, though a deal with prosecutors to end the case is not ruled out.
