Talwani argued that the government's action was based on a flawed interpretation of immigration law, and that expedited deportation applies to non-citizens who entered the U.S. illegally, not those authorized to stay, such as those under the CHNV program.
The CHNV program was implemented under the administration of Trump's predecessor, Joe Biden, in October 2022. It permitted up to 30,000 migrants per month to enter the U.S. and initially stay for two years due to human rights conditions in their home countries. As the 2024 presidential election approaches, Trump is campaigning for office with a firm stance on border control and irregular migration. His controversial promises of a massive deportation campaign frequently face legal challenges.
