Her child was forcibly handed over to Francesco Arcuri, a man considered a 'presumed abuser' who has 'control' over the child, one of his main victims and witnesses.

Arcuri, the former husband of Juana Rivas, faces allegations of physical and psychological abuse towards his children. He will be judged in Cagliari, Italy on September 18, for these charges. Interestingly, Arcuri himself stated in an interview last July that this trial does not worry him and it will serve to make the truth known.

The lawyers leading Juana Rivas' legal team recall that Arcuri made a threat to Juana Rivas: 'I will take the children away from you and make your life impossible.' This threat, they allege, was supported by the Granada judicial system, allowing Arcuri to continue his actions against Juana Rivas.

The Court of Instruction number 3 of Granada allowed the transfer of the child to live with his presumed abuser. This decision has led to a 'serious legal and social anomaly', according to the lawyers. They believe that the criminal process against Arcuri in Cagliari will correct the disconnection between civil and criminal jurisdiction.

It is important to note that Arcuri has only been convicted once for abuse, towards his then-wife, in 2009. The accusation against Juana Rivas by Francesco Arcuri was a complaint for the alleged abduction of Daniel, their minor son, aged 11. However, the complaint was filed by the Provincial Court of Granada on June 24, and Daniel returned to Italy with Francesco Arcuri on June 25, in compliance with an Italian justice resolution.

The legal team of Juana Rivas has revived the process, accusing 'part of the Granada judicial system' of siding with Francesco Arcuri. They claim that there has been a violation of basic principles such as the prejudiciality of criminal law.

As this case unfolds, the public awaits the outcome of the trial in Cagliari on September 18, hoping for justice for all parties involved.
