Texas Governor Greg Abbott is withholding months of communications with Elon Musk and representatives from Musk's companies, asserting that the emails contain private and potentially embarrassing information not of legitimate public interest.

The governor's office initially estimated it would take over 13 hours to review the records and provided a cost estimate of $244.64. However, after the payment was made, the governor's office claimed all of the records were confidential and sought the advice of Texas Attorney General Ken Paxton.

Lauren McGaughy, a journalist with The Texas Newsroom, a collaboration among NPR and the public radio stations in Texas, requested Abbott and his staff's emails since last fall with Musk and others associated with his companies. Musk and representatives for his companies did not respond to requests for comment for this story.

Bill Aleshire, a Texas-based attorney specializing in public records law, expressed concern about the governor claiming that months of emails between his office and Elon Musk are all private. Aleshire stated that the Texas Newsroom was charged $244 for records that are not being provided, and he finds it unusual for the exception of common-law privacy to be cited in cases involving a businessman.

The communications consist of private exchanges with lawyers, details about policy-making decisions, and information about how the state entices companies to invest. Kevin Bagnall, a lawyer representing Musk's rocket company SpaceX, wrote a letter to Paxton's office arguing the emails should be kept secret, citing competitive harm as the main reason.

The Texas Supreme Court's recent ruling has limited the enforcement of public records laws against top state officials like the governor. This interpretation restricts the scope of public records laws, making it harder to compel disclosure of communications involving high-ranking officials. As a result, Abbott's refusal to release his communications with Musk creates a significant limitation on transparency in Texas government.

The communications are currently under review by the office of the attorney general, which has 45 business days to determine whether to release Abbott's records.
