In the wake of a court ruling declaring border rejections of asylum seekers as unlawful, the Refugee Council of Brandenburg has lashed out at the federal government's baffling disregard for legal norms and humanitarian concerns. The organization has urged Brandenburg's Interior Minister René Wilke to take a stand.

The Refugee Council criticizes the federal government for brazenly overriding court rulings and European regulations, labeling their actions as a "shameful" breach of the rule of law. Asylum seekers are being subjected to unspeakable suffering, and the rule of law is being callously undermined. Wilke must step up to halt this reprehensible practice that clearly violates European law, the council insists.

The contentious issue revolves around three Somali asylum seekers who were denied entry at Frankfurt (Oder)'s border checkpoint in Brandenburg and sent back to Poland. A Berlin Administrative Court ruling, however, declared this practice as unlawful. The court emphasized that asylum seekers should not be rejected without first determining which EU country is responsible for processing their claim under the Dublin procedure.

Federal Interior Minister Alexander Dobrindt, despite the court's decision, asserted that he would not alter the border policy. Instead, Dobrindt planned to seek a main proceedings. However, Dobrindt claimed that the court's ruling was an "individual decision," and does not warrant any immediate policy changes. That being said, Dobrindt admitted that there are exceptions for vulnerable groups such as children and pregnant women.

Brandenburg's borders have been reinforced under strict federal government guidelines since May 2025, under the coalition pact between CDU/CSU and SPD. The current government led by Chancellor Friedrich Merz has pursued a tougher stance on migration policies.
