Government in Alberta seeks to overturn court order halting transgender health care legislation

The province contends that the injunction was issued prematurely, as the law had not yet been fully implemented, and alleges that the judge erred in determining it would lead to irreversible damage.

Government in Alberta seeks to overturn court order halting transgender health care legislation

Alberta is currently appealing a temporary injunction against its controversial law restricting gender-affirming care for minors. The injunction was issued in June 2025 by Justice Allison Kuntz, who ruled that the law likely causes irreparable harm to gender-diverse youth and raises serious Charter issues that need full court examination.

The law, passed by the Alberta government, restricts treatments such as puberty blockers and hormone therapy for minors under 16, and imposes a total ban on gender-reassignment surgery for minors. The government argues that the injunction is premature, stating that the law aims to protect children from potentially irreversible medical decisions.

LGBTQ advocacy groups and affected youth support the injunction, emphasizing the harm the ban would cause. Egale Canada, one of the groups challenging the law, believes the judge made the right decision in ruling that the law is likely to cause irreparable harm to gender diverse youth.

The appeal was filed to the Alberta Court of Appeal in late July 2025, with the provincial government, led by Premier Danielle Smith, committed to defending the law. The court challenge centers on the balance between protecting the rights of transgender youth and the government’s stated intent to protect minors.

Meanwhile, in other news, Donald Trump has confirmed face-to-face talks with Vladimir Putin amid sanction threats. Trump announced plans to meet with Putin in Alaska next week to discuss the Ukraine war. The meeting is expected to be the first between the two leaders since Putin's invasion of Ukraine.
