Government Demolition of Gbenga Daniel's Properties Halts by Court Order
In a recent development, the High Court in Sagamu, Ogun State, has issued an interim order restraining the state government and its agents from demolishing or tampering with the properties owned by a former governor of Ogun State, Gbenga Daniel [1]. The suits, marked HCS/371/2025, HCS/373/2025, and HCS/372/2025, were filed by Daniel and his wife, who are seeking an order to protect their properties, including Asoludero Court, a property belonging to Daniel's wife, and Conference Hotel, located in Sagamu.
The interim order is effective until the hearing and determination of the motion on notice for the interlocutory injunction, which is scheduled for August 19, 2025 [2]. However, the court has directed Daniel to submit property documents within two weeks to prove ownership and permits for the buildings in question [3][4][5].
The defendants in the suits are Governor Dapo Abiodun, the Attorney General of Ogun State, Ogun State Planning and Development Permit Authority, and the Ogun State Commissioner for Physical Planning and Urban Development. The state government issued a quit and demolition notice for Daniel's private residence and hotels in Sagamu.
The properties in question are located within the amended part of the Government Reservation Area. The Asoludero Court has a Certificate of Occupancy with No. LUD3/LR2693, dated 20th January, 2010. The former governor, through his lawyer, filed three separate suits seeking an ex parte order to restrain the defendants from tampering with the Asoludero Court, the Conference Hotel, and its annexe, all located at Obafemi Awolowo Avenue, GRA, Sagamu.
Justice O.S Oloyede, in the ruling, said the Court needed to take immediate action on the suits having read all the affidavits in support and affidavits of urgency to intervene in the cases. The previous interim order restraining the state government and its agents from demolishing or tampering with the properties remains in effect. The hearing of the application for an interlocutory injunction is scheduled for August 19, 2025.
