Government boosts efforts to eliminate unauthorized structures; establishes investigative panel
Kuwait's Finance and Legal Committee Tackles Unauthorized Use of State Land
In a move to address the unauthorized use of state land for commercial purposes, the Municipal Council's Finance and Legal Committee has established a fact-finding subcommittee. This subcommittee will investigate encroachments and unlawful commercial exploitation of government-owned property.
The subcommittee's tasks include identifying sites of commercial encroachments on state property without legal basis, verifying compliance of relevant authorities with procedures in addressing violations, and investigating illegal commercial activities in undesignated areas. The committee will also summon relevant ministries, such as finance, municipality, and commerce, to provide documentation and data.
The subcommittee's formation is in response to increasing concerns about the misuse of state land. Committee Chairman Fahad Al-Abdul Jader stated that the widespread misuse of state land for private commercial gain, often without proper licenses or legal justification, is a growing concern. He emphasized that this violation of public funds undermines the principles of equal opportunity and justice.
The committee's actions are part of an effort to enforce regulations and curb the misuse of public land. The violations are significant and varied, requiring a systematic review of the oversight mechanisms within government institutions. The committee's mandate includes examining both the direct exploitation of state property and commercial activities in non-designated areas.
The recent steps taken to address this issue were primarily issued by the Cabinet and ministries rather than directly by the Municipal Council's Finance and Legal Committee. The focus is on a government-wide coordinated response, involving multiple ministries and agencies to combat encroachments on state lands.
The committee approved a request from the Public Prosecution for exemption from fees related to issuing property description certificates for legal cases. However, the committee deferred discussion on Kuwait University's request to be exempted from Clause 7 of Article 1 of Ministerial Resolution No. 206 of 2009, related to the medical campus project.
The committee was formed in response to government instructions aimed at curbing the misuse of public land and enforcing existing regulations. The subcommittee is expected to commence its work within two weeks and will develop operating procedures to guide its investigation. Upon completion, the subcommittee will submit a final report with findings and actionable recommendations to the parent committee.
