Cannabis cultivation clubs in Germany have been operating legally since the Cannabis Act took effect in July 2024. By February 2026, around 125 licensed clubs are active nationwide, with 11 based in Schleswig-Holstein alone. However, authorities now warn that the law's implementation is creating unexpected challenges for both regulators and the clubs themselves.
Since legalisation, nonprofit cannabis associations in Schleswig-Holstein have distributed more than 25 kilograms of cannabis to their members. Eight of the state's 11 clubs are currently growing the plant, while five handle distribution. Yet many have struggled with the administrative demands, forcing extra reviews and corrections to meet strict rules on child protection, health safety, and non-commercial operations.
The Ministry of Agriculture, led by the CDU, has voiced strong opposition to the Cannabis Act. Officials argue that enforcing the law is overburdening authorities, as licensing and oversight require heavy bureaucratic and staffing resources. In response, state bodies have drafted proposals to simplify enforcement, aiming for clearer, less cumbersome regulations.
A formal letter outlining these concerns is now being prepared for the Federal Ministry of Health. The goal is to push for amendments that address the current strain on local agencies while maintaining the law's core safeguards.
The Cannabis Act has enabled over 100 clubs to operate legally across Germany, but its rollout has revealed practical difficulties. Schleswig-Holstein's authorities are now seeking adjustments to reduce bureaucratic pressure while keeping strict controls in place. The outcome of their proposals may shape how the law functions in other states.
