Gambling Advertisement Violations Cautioned by ACMA Regarding 10 Play
Australian Communications and Media Authority Warns Network Ten Over Gambling Ad Breach
The Australian Communications and Media Authority (ACMA) has issued a formal warning to Network Ten for breaching gambling advertisement rules on its streaming service, 10 Play. The warning came following a complaint by a viewer and was issued in October 2023.
The breach occurred during the live streaming of the Women's A-League match between Central Coast Mariners and Newcastle Jets, as well as the Socceroos' friendly match against England on October 14, 2023. According to ACMA member Carolyn Lidgerwood, the purpose of the gambling promotional content rules is to minimize potential harm.
Lidgerwood emphasized the need for Network Ten to improve its compliance with the regulatory framework, stating, "It's crucial that online content providers like 10 Play adhere to the established regulations when it comes to gambling advertisements, particularly during live sports events."
The breach at 10 Play was due to an error in a manual coding process. In response, 10 Play has implemented an upgrade to its internal processes to ensure the scheduling of gambling ads follows the regulatory framework. The company cooperated with ACMA and confirmed that the breach was their first.
ACMA vowed to take further enforcement action against 10 Play in case of subsequent breaches of the established regulations. Lidgerwood highlighted the importance of offering gambling ads in compliance with the law, stating, "We will not tolerate breaches of the regulations, and we will take appropriate action if Network Ten breaches the gambling ad rules for online content providers again."
Recently, the ACMA confirmed the ban of two offshore gambling operators for breaching the country's gambling regulations. Online content providers must not show gambling ads during live sports events between 5 AM and 8:30 PM, with a five-minute buffer before and after each event.
Lidgerwood also emphasized the importance of Network Ten upgrading its internal processes to prevent future breaches of the gambling ad rules. The upgraded internal processes at 10 Play are intended to ensure compliance with the regulatory framework and protect viewers from potential harm.
