Düsseldorf's Administrative Court Hears Case Against Ex-IS Germany Chief, Abu Walaa
Fighting Deportation: Case of Previous IS-Germany Head - Fugitive ex-chief of IS Germany resists forced removal from the country
In the courtroom of the Administrative Court of Düsseldorf, the former IS Germany chief, Abu Walaa, faces the fight against his expulsion from Germany this Wednesday (Case No. 27 K 7349/23). The hearing comes after his urgent application against his expulsion largely failed in Düsseldorf last year, leading to the main proceedings.
On the banks of the Lower Rhine, the convicted IS terrorist, serving a nine-and-a-half-year sentence, will be transported to Düsseldorf from his prison. The court is set to review the revocation of his residence permits and discretionary obligations, including being confined to a specific city following his prison release and daily reporting to the police.
Abu Walaa's threat to public security is the justification for his expulsion. Last year, the court confirmed the lawful nature of the district of Viersen's actions, stating that the danger he posed to public security was so profound that it overshadowed the interests of his seven children.
The court’s verdict declared Abu Walaa’s sentencing by the Higher Regional Court in Celle as a fact, which the Federal Court of Justice later upheld. The trial against the Iraqi preacher, along with three other men, lasted over three years. The judges deemed that the men had radicalized young people, particularly in the Ruhr area and Lower Saxony, and sent them to fight for the Islamic State in Syria and Iraq.
Abu Walaa, the imam of the mosque of the now-banned German-speaking Islamic Circle in Hildesheim, had used his apartment in Dortmund as a prayer center. He also temporarily housed the Berlin Christmas market attacker Anis Amri. The men were arrested in November 2016.
It is uncertain whether Abu Walaa faces the death penalty in Iraq. Although several obstacles stand in the way of his expulsion to Iraq and a permanent ban on re-entry, the expulsion threat by the district of Viersen was deemed lawful last year. The legal complexities surrounding extradition and death penalties intensify these issues.
