The ruling stems from an urgent decision made by the Berlin Administrative Court, which declared the turnaway of three Somalis at a border control in Frankfurt (Oder) as illegal. Rejecting asylum seekers is only permissible if the responsible EU country for their application is clear[1]. Under existing European law, the asylum seekers may not be denied[3].
