In a move aimed at resolving ongoing disputes between the Long Island Rail Road Company and certain of its employees, President Donald J. Trump has issued an order establishing an emergency board. The emergency board was created effective 12:01 a.m. Eastern Daylight Time on September 18, 2025.

The board, composed of a chair and two other members, all appointed by the President, has been tasked with investigating and reporting on the disputes within 30 days of its creation. For 120 days from the date of the emergency board's creation, no changes can be made to the conditions causing the disputes without agreement from all parties (Sec. 3).

The disputes in question have not been adjusted under the provisions of the Railway Labor Act, as amended. The parties empowered by the RLA have requested that the President establish an emergency board. The order was issued under the authority vested in the President by the Constitution and the laws of the United States of America, including section 9A of the Railway Labor Act.

The emergency board will perform its functions subject to the availability of funds, with the costs for publishing this order being borne by the Department of Transportation (Sec. 6). Upon the submission of its report (Sec. 5), the emergency board will terminate. The records and files of the emergency board will be maintained by the National Mediation Board upon the board's termination (Sec. 4).

It is important to note that no member of the emergency board shall be pecuniarily or otherwise interested in any organization of railroad employees or any carrier. This order was issued on September 16, 2025.

The disputes involve the Long Island Rail Road Company and certain of its employees, represented by the Transportation Communications Union, the Brotherhood of Locomotive Engineers and Trainmen, the Brotherhood of Railroad Signalmen, the International Association of Machinists and Aerospace Workers, and the International Brotherhood of Electrical Workers.

On September 18, 2025, at 12:01 PM Central European Summer Time, the President appointed an emergency commission consisting of a chairman and two additional members to investigate and report on these disputes. The President's decision to establish the emergency board underscores his commitment to resolving these longstanding disputes and ensuring the smooth operation of the Long Island Rail Road.
