The first alleged sexual assault reportedly occurred during Combs' 40th birthday party in a penthouse of the Plaza Hotel. The woman testified that after calling her into the kitchen and sending everyone else out, Combs praised her work and offered vodka toasts for his birthday. The shots, according to the woman, had an unusually strong effect on her.
She explained her reasons for never reporting the assaults to the police, fearing Combs' violent outbursts, being blacklisted from the entertainment industry, and the police's potential lack of seriousness due to Combs' celebrity status.

Ventura and the witness are said to have experienced Combs' violent outbursts, with security guards from late superstar Prince even intervening once after an altercation at Prince's house.
