The anti-right-wing music festival "Jamel Rocks the Förster" experienced a setback in its legal squabble with the town of Gägelow over venue fees during an emergency court hearing. The Administrative Court of Schwerin denied an immediate appeal filed by the event organizers. The final judgment is still pending, but the organizers remain optimistic.
The court dismissed the petition, stating that the organizers had not sufficiently demonstrated that paying the 7,870 euro usage fee would cause substantial harm to their operation. Given the event's overall expenses, which cover admission prices, this fee represents a relatively minor component. The organizers have the option to pay the fee temporarily and contest it subsequently, the court declared.
In January, the Gägelow city council, situated in the district of Nordwestmecklenburg, decided to institute a usage fee for the first time, charging the festival organizer 0.78 euros per square meter for the four-week use of the event grounds. Mayor Christina Wandel had stated previously that this fee would apply to the annual open-air festival in Jamel.
Organizers Remain Positive
Despite the temporary setback, the organizers remain upbeat about the main proceedings, as the Administrative Court acknowledged that the event may be considered an assembly, and the organizers might have a valid land use claim.
The event's lawyer shared: "We expect, based on the rationale of the VG Schwerin, which will continue to adjudicate the subsequent legal dispute, that the festival can take place as an assembly in accordance with organizers' plans, and that no exorbitant lease agreement is necessary."
Festival Registered as Assembly
The event has now been registered as an assembly with the relevant authorities. "The organizer has also requested the assembly authority to clarify within a specified timeframe that the assembly will not be subject to a provision restricting it on the designated municipal land," said the lawyer. "If the clarification is not forthcoming, the organizer will consider whether to appeal the VG's decision or submit a new request for legal recourse."
Court Contemplates Freedom of Assembly
The court did not definitively rule in favor of the organizers regarding free use of municipal land, as in prior years. However, this issue will be addressed in the main proceedings, explained a court spokesman.
The court suggested that "Jamel Rocks the Förster" may have a claim to free use of the municipal land. This question was not addressed in the interim ruling and will be clarified in the future. The Administrative Court further stated that the event may have municipal law-based land use rights, as "the areas were, in the past, for political events, factually made available in the manner of a public facility."

The interim decision of the administrative court is not yet final. The applicant can file an appeal with the Higher Administrative Court of Mecklenburg-Vorpommern.
The music and democracy festival "Jamel Rocks the Förster" was founded in 2007 by the Hamburg-based duo Horst and Birgit Lohmeyer. The event counteracts right-wing extremism. Last year, among the performers were the Fantastic Four and Olli Schulz.
