German Football Association Fined for Tax Evasion in "Summer Tale" Trial

Football club in Germany Faces Financial Penalty

In a damning verdict, the German Football Association (DFB) was hit with a €110,000 fine for dodging taxes, as declared by presiding judge Eva-Marie Distler in the Frankfurt Regional Court on the final day of the 34th trial. The trial, dubbed the "Summer Tale" (Sommermärchen), investigated financial improprieties linked to the 2006 FIFA World Cup hosted by Germany.

In the beginning of the week, the court had branded the case as demonstrating "high criminal energy." However, the DFB flatly rejected the charges, maintaining its innocence. They asserted that no financial loss had been incurred by the tax office but rather a profit of €650,000 was booked.

The DFB's shoddy handling of the matter left the association with a "disastrous picture," as Distler put it in her explanation. In addition to the fine, the DFB has been ordered to pay €130,000 and bear the costs of the trial proceedings.

The conviction significantly diminishes the DFB's chances of securing a hoped-for tax refund of €22 million. The association was compelled to pay this sum to the tax office in 2017 for the revocation of its tax-exempt status for the 2006 tournament due to the World Cup affair. The DFB has already sued the Finance Administration Court in Kassel to challenge this decision.

At heart of the proceedings was a DFB payment of €6.7 million to FIFA in April 2005. This money was transferred to Robert Louis-Dreyfus' account and represented the ten million Swiss francs Franz Beckenbauer had received from the French entrepreneur in 2002. The DFB concealed the repayment of the loan as a contribution to a planned World Cup opening ceremony, which was later cancelled, declaring it as a business expense a year later.

Initially, top DFB officials Theo Zwanziger, Wolfgang Niersbach, and Horst R. Schmidt were charged. The proceedings against all three suspects, who consistently denied the allegations, were eventually discontinued with financial penalties.

This trial underscores the legal and ethical pitfalls in sports administration and puts the spotlight on the financial practices behind hosting international sports events. The ruling serves as a reminder of the need for greater transparency and compliance in managing such events to prevent future scandals.
