Dugan was arrested a week later and has pleaded not guilty to the charges, claiming that she is immune from prosecution for official judicial acts. Her lawyers have referred to her arrest as "virtually unprecedented" and "entirely unconstitutional."

Video footage from the courthouse's more than two dozen surveillance cameras supports both prosecutors and defense attorneys' arguments in the case. The video, devoid of audio, depicts federal agents arriving in plainclothes and staking out positions throughout the hallway. Dugan's arrival is captured by several cameras, and she is seen engaging with the agents before directing them to the chief judge's office.

The man is seen exiting through a non-public door that was just a few feet from the main entrance to the judge's courtroom. One agent had never left his spot across from the courtroom, while another had returned from the chief judge's office prior to Flores-Ruiz's exit and followed him.

Dugan's defense team, led by former United States Solicitor General Paul Clement and attorney Dean Strang from "Making a Murderer," has argued that her actions were judicial acts for which she has absolute immunity from criminal prosecution. Dugan is set to stand trial in July.
